Enacted March 6, 2018, the Alabama Tax Delinquency Amnesty Act of 2018 will create a tax amnesty opportunity for taxpayers with delinquent Alabama tax liabilities. The Alabama Department of Revenue (DOR) will establish a program to accept amnesty applications beginning July 1, 2018, and ending September 30, 2018. The program will cover all taxes administered by the DOR other than motor fuel, motor vehicle and property taxes. All penalties and interest will be waived for tax periods that began prior to January 1, 2017, and in many instances these tax types will be eligible for a limited look back period of three years.

Applications must be submitted electronically and waive all rights for protesting the associated tax and interest due. The associated tax amounts will be ineligible for refund or redetermination, unless associated with a properly claimed net operating loss or adjustment made by the IRS to a taxpayer’s federal income tax return. All returns, payment and supporting documentation for the covered period must be submitted by November 15, 2018. Returns and payment due for the current year also must be submitted at this time.
